Kristofferson wrote this about 1980, releasing it first as a single in -81, then with the collaboration album "The Winning Hand" with Willie Nelson, Brenda Lee and Dolly Parton in -82. It's found on the compilation "The Essential Kris Kristofferson" (2004) and a couple of live albums.
Kris grabbed the scene from John Steinbeck's 1939 novel "Grapes of Wrath", chapter 15. With such an amazing result, I think Steinbeck himself would have given him applause.
